I think it will benefit me and my readers to do this instead of spending any time blogging. When I return the blog will be more focused, more useful, and, probably most importantly, more&#8230;how should I put this?&#8230;independent? </p>

<h1 align="center">EAT</h1>
<p>Because M and I went to The Restaurant at the Canterbury Hotel (yes, that&#8217;s the real name of it) as part of <a href="http://www.devourdowntown.org/summer.html">Devour Downtown</a>, my calories for today are somewhat of a guess, and my guess is that they are on the low side of guessing, but without further adieu:<br />
<br />Total Calories: <b>1464</b><br />
<br />Percentage of Calories from Fat: <b>27.5%</b><br />
<br />Percentage of Calories from Protein: <b>27.2%</b><br />
<br />Grams of Fiber: <b>19 g</b></p>
<h1 align="center">RUN</h1>
<p>Although it was almost 9:30 by the time we got home, I laced up my running shoes and went out for a quick 2 mile run. I actually think it was a really fast two mile run for little slow poke me, but I will never find out as the Garmin died 1.3 miles in <img src='http://s0.wp.com/wp-includes/images/smilies/icon_sad.gif' alt=':-(' class='wp-smiley' />   After the run, I convinced M to take the dog out for a walk with me it. The weather was lovely tonight. I could have (and perhaps should have) run forever!</p>
<h1 align="center">LITIGATE</h1>
<p>This category is hard to write something about every day. The stuff I do has become quite routine for me. I&#8217;m sure it&#8217;s far from boring to most people, but after a year (I can&#8217;t believe it&#8217;s only been that long) of doing this stuff it&#8217;s become quite mundane to me. That doesn&#8217;t mean I don&#8217;t get a crazy call daily from a variety of clients or that I&#8217;m not learning about how small Indianapolis is once we learn about all the affairs in the city &#8212; which by the way seems like the smallest city on earth when you start doing this stuff. It&#8217;s just at this point it seems like almost nothing will shock me. In a year of doing this I&#8217;ve seen the good (parties who hated each other being able to agree what was best for the kids without an argument or second thought), the bad (countless cases of infidelity and being hit on by a 75 year old client) and the ugly (domestic abuse and a XXX picture from a client&#8217;s soon to be ex-husband).</p>

<p>I&#8217;m sure your first thought when you didn&#8217;t see my post last night (you noticed, right?) was that I had a bad day.  While that&#8217;s partially true, it&#8217;s not the reason I didn&#8217;t post. I didn&#8217;t post because I went to bed really early and feel fantastic today. If I haven&#8217;t mentioned it before, I&#8217;m using <a href="http://www.livestrong.com">Livestrong/Daily Plate</a> to track of all of my eats and I have managed to do so all three days this week. Tonight will be a struggle as I&#8217;m heading to a fancy dinner with M, but I&#8217;ll do my best to put something into Daily Plate.</p>
<p>Instead of the chart I normally post, I&#8217;ll just post the end of day stats:<br />
<br />Total Calories: <b>1476</b><br />
<br />Percentage of Calories from Fat: <b>26%</b><br />
<br />Percentage of Calories from Protein: <b>16%</b><br />

<h1 align="center">RUN</h1>
<p>I managed to do a whole lot of nothing. Yeah that&#8217;s my second &#8220;rest&#8221; day this week, which is no good considering getting a work out in today will be quite a struggle. I think I&#8217;m going to make a real effort to go to the gym and do a quick run late tonight after dinner or at least do Thirty Day Shred.  I&#8217;ve gotta be honest: <b>I think I&#8217;ve lost my work out motivation.</b> I&#8217;m hoping it&#8217;s just a slump and it will come back. I think part of the problem is that I&#8217;ve been doing the same thing for several months now (training for the triathlons) and so there hasn&#8217;t been much variety in my work outs. As soon as the triathlon is over on the 29th, I&#8217;m going to start doing more running, a class at the gym (it&#8217;s a Body Pump type class), and perhaps some spinning (particularly when the weather starts to cool down). And I will probably quit swimming or swim only once a week until next spring. </p>
<h1 align="center">LITIGATE</h1>
<p>I think that the thing about being attorney that is so weird is the <b>billable hour</b>. I know that lots of professions have these (engineers, consultants, accountants), but because I went straight from college to law school, I have no experience being an employee other than an hourly one. The difference, as you may or may not know, is that every hour you at work when you have a billable hour requirement is not billable. That means that some days I&#8217;m at the office for 11 or 12 hours and I only have 8 billables. What&#8217;s even worse are days when you are at the office all day and only have 3-4 billables. It&#8217;s like taking a half vacation day <b>but being at work</b> &#8212; a terrible result if you ask me. Thankfully I&#8217;ve learned and am learning more and more each day how to become more efficient at my billable hours.  What makes me nervous about them is that right now, during the week, I barely have the energy to go to the gym after work &#8212; what is going to happen to my work out routine if/when I have kids <i>on top</i> of work?? That&#8217;s a scary thought.</p>

<p>I know that I started out this well last week and it was abysmal after that, but I&#8217;m optimistic this week will be better.</p>
<h1 align="center">RUN</h1>
<p>I swam <b>950 meters</b> tonight, including 500 meters straight of freestyle. I haven&#8217;t swam that long straight of freestyle in a long time. In case, I forgot to mention it, I swam breast stroke the whole time during the triathlon except for the first few strokes. I just wasn&#8217;t comfortable doing freestyle and I wanted to start the triathlon out confidently which I knew I could do if I did breaststroke (although it would be a slower confidently).</p>
<p>I hopped out of the pool and onto the treadmill. I made this a tempo run and ended up doing my fastest <b>3 miles</b> EVER! 3 miles in <b>27 minutes</b>. Overall a great workout!</p>
<h1 align="center">LITIGATE</h1>
<p>I wonder if a study has ever been done on individuals going through civil litigation and how different they act/think while going through such litigation. I am frequently amazed by the words that come out of people&#8217;s mouths.</p>

<p>My eats for today were decent. I ate a few unknowns though: M made the sweet potato fries and put about 5 times too much oil (but I cannot complain because he did most of the cooking tonight!) and I had a wrap for lunch (I used Subways chicken bacon ranch wrap for my calorie count). I didn&#8217;t snack today because I think I was snacking too much. Further, if I&#8217;m going to eat out for lunch I&#8217;m eating more calories because of that so I need to make up and eat less calories at another point.</p>

<h1 align="center">RUN</h1>
<p>No runs today as I just ran a triathlon (yes, I put marathon here the first time, maybe someday that will be true but today far from it) <a href="http://eatrunlitigate.blogspot.com/2009/08/tri-indy-2009.html">yesterday</a>. I thought I deserved a day off <img src='http://s1.wp.com/wp-includes/images/smilies/icon_wink.gif' alt=';-)' class='wp-smiley' />  I am planning a swim on the a.m. but if I&#8217;m too tired when the alarm goes off that may not happen (hey, I&#8217;m all about honesty around here). Hoping for a good week. Not going to say any grandiose things like it will be a peak week, but just hoping for a good, strong week. That can help me build on this first tri leading up to the next one.</p>
<h1 align="center">LITIGATE</h1>
<p><P>I usually get my daily legal gossip from <a href="http://www.abovethelaw.com">Above the Law</a>, but I recently put that in my outlook reader instead of <a href="http://www.google.com/reader">Google Reader</a> because of a meeting I went to last week that recommended the Outlook function. The problem with this is that I forget that it&#8217;s in my outlook so I haven&#8217;t been reading ATL like I used to. I&#8217;m out of the legal gossip loop. A loop I have been in for a year straight. It&#8217;s rather refreshing to be honest. The legal gossip loop has been, in case you weren&#8217;t aware, the most depressing loop for the last year. The large law firm economy tanked approximately seven seconds after I started working (I&#8217;m hoping there&#8217;s no correlation between these two events!) so my law gossip reading has consisted of reading about people getting laid off, firms dissolving, pay cuts occuring, and, worst of all, seeing my own friends at my own firm let go. It still makes me mad. So maybe this out of the loop thing isn&#8217;t so bad. I can live outside the loop for a while and hope that when I return things will be happy again! (I don&#8217;t think there&#8217;s a chance in hell that my sabbatical from the loop will last much longer which means this is a pipe dream &#8211; but I can dream, right?)</p>

<p>Had I not totally sucked up the run, I would have finished around the 200 mark (which would have made me seventh in my age group and first in the fat chick category). Overall the race went very well.</p>

<p>So yes, this seems low. But I also had 1 and 1/2 pieces of fudge and 2 fun size Heath bars. I think that with those calories I&#8217;m more in the 1400 range.

<h1 align="center">RUN</h1>
<p>Did 5 miles on the treadmill. Was going to do them slow at 5 mph, but just couldn&#8217;t resist bumping it up. Ended up doing it in like 53 minutes instead of 60. Tomorrow, I&#8217;m biking and running the triathlon course with my friend who is also doing the triathlon.
</p>
<h1 align="center">LITIGATE</h1>
<p>I discovered today that there is a statute in Indiana that requires people to support their parents if they become incapable of supporting themselves, the child is financially capable (I&#8217;d be interested to know what that actually meant) and assuming the parents supported the child until the child was 16.  Although I would care for my parents if they became incapable of doing so themselves I think it is ridiculous to have such a statue. Just a random discovery while working today.</p>
<p>So this is my proposed new format. I have some ideas for nifty graphics to use in there but those are going to take some work, so for now this will work. The thought I had yesterday was to break it up into three daily posts, but given that I can hardly post once a day I think this will have to do. <b>What do you think?</b></p>

		<title>Why am I always back at square one?</title>

			<content:encoded><![CDATA[<p><span style="font-weight:bold;">Sad truth #1</span>: I haven&#8217;t been on track with my diet for a consistent period of longer than 5 days in <span style="font-style:italic;">months</span>.</p>
<p><span style="font-weight:bold;">Sad truth #2</span>: I haven&#8217;t followed a work out plan in weeks. I make them, but I don&#8217;t actually follow them. And I already won&#8217;t be following this weeks as I didn&#8217;t work out tonight because <strike>I didn&#8217;t have time</strike> I was too lazy. I choose instead
</p>
<p><span style="font-weight:bold;">Sad truth #3</span>: I have been eating out more and more every week. I was doing okay for a while there, but today I ate a 251 wrap for lunch and sushi for dinner. Both were delicious, but both will not help me lose any weight
</p>
<p><span style="font-weight:bold;">Sad truth #4</span>: I weighed myself tonight and I am back to where I was when I wrote <a href="http://eatrunlitigate.blogspot.com/2009/06/new-plan.html">this post</a>. That was over a month ago.</p>
<p><span style="font-weight:bold;">Sad truth #5</span>: I have really started to think about where my food comes from. I don&#8217;t think its coincidental that as the ingredients of our food have become more and more unpronounceable that cases of infertility, cancer, and other random diseases and problems have been on the rise.  I have all kinds of excuses for why I let myself eat that crap (ease, affordability, etc.) but the main reason I eat is because it tastes good. Well that&#8217;s the worst reason of them all. It tastes good because it is <span style="font-weight:bold;font-style:italic;">fake</span> and <span style="font-weight:bold;font-style:italic;">synthetic</span>. If I am really doing this weight loss/fitness kick in order to get healthier than I need to actually consider my health. I am ignoring my health if I eat random chemicals because they taste good or are easy to make.
</p>
<p>If I plan to actually lose weight and get beyond this plateau I have been at for several months I will never reach my goal, so here I go again. I am like a freaking broken record around me.
</p>
<p><span style="font-weight:bold;">New reality #1</span>: It doesn&#8217;t matter how good something tastes or how it easy it is to make. I need to know what is going into my body. I am going to start eating clean. This means I will primarily be eating fruits and vegetables, lean meats, dairy, etc. The real  key is that if there is an ingredient list on the package I need to read it and know what each ingrediet is. If I don&#8217;t, I&#8217;m not eating it. Period.
</p>
<p><span style="font-weight:bold;">New reality #2</span>: I am back to counting calories. 1500 maximum per day (with some calculations on days with long work outs to make sure I do not do harm to my body by significant calorie deficiencies). No more wishy-washy range. No more skipping days when it&#8217;s convenient.  I need to lose some weight and I&#8217;m going to quit pretending that I&#8217;m okay with the weight I am at right now. Sure I&#8217;m happy that I am not the weight I <span style="font-style:italic;">was</span>. But I am not yet satisfied with where I am. I will be honest and say that the major reason for this is for appearance reasons, but I also know that the weight loss will aid in increasing my speed in both biking and running&#8230;and probably swimming as well!  </p>
<p><span style="font-weight:bold;">New reality #3</span>: I am going to make a work out plan every week and I am going to make that work out happen. I think I need to look at my work schedule more as I figure out my work out schedule so that my work out plan can be realistic. I also need to get back in the swing of working out in the morning. I think when I was the most successful at my weight loss when I was working out several mornings a week.
</p>
<p><span style="font-weight:bold;">New reality #4</span>: Lolly-gagging my way through this has not been working. No more lolly-gagging. Tomorrow, a Tuesdsay, which some may think isn&#8217;t the best day to start is going to be the start for me.
</p>
<p><span style="font-weight:bold;">New reality #5</span><span>: Back to daily posts. I would ideally like to do three posts a day. I&#8217;m going to work out the logistics, but I have a catchy idea for the various entries. I think it may work, but I&#8217;ve gotta figure out if I really have it in me to do three posts a day.</span><span style="font-weight:bold;"><br />

			<content:encoded><![CDATA[<p><b>7 days until my first triathlon!!!</b> I have no idea how I&#8217;m going to do time-wise, but I can tell you that this week which was supposed to be my peak week was not my peak. I think my plan is to make the triathlon this week my test tri and the one in 3 weeks will be the real attempt (my goal at that one will be to break 1:30).</p>
<p>My totals for this week were:
</p>
<ul>
<li><b>Monday</b>: 3 mile run in the morning, 1000 yard swim in the evening, and weight lifting session</li>
<li><b>Wednesday</b>: 5 mile run</li>
<li><b>Saturday</b>: 5 mile run</li>
<li><b>Sunday</b>: 11.5 miles (would have went further but it was atrociously hot) so I decided to go to the gym and do 750 yards in the pool</li>
</ul>
<p>My plan for this week is to take it somewhat easy:
</p>
<ul>
<li><b>Monday</b>: 12.5 mile hard ride in the a.m.; swim in the evening</li>
<li><b>Tuesday</b>: 5-6 mile easy run</li>
<li><b>Wednesday</b>: 12.5 mile ride + 3 mile run on the actual course with my friend who is also running the triathlon</li>
<li><b>Thursday</b>: Nothing</li>
<li><b>Friday</b>: easy bike ride or run</li>
<li><b>Saturday</b>: nothing</li>
<li><b>Sunday</b>: <b>RACE DAY!!!</b></li>
</ul>

			<content:encoded><![CDATA[<p>I managed to drag my butt out of bed this morning and run 3 miles as the sun rose (this was my NSV). Sadly, I did not feel nearly as energized today as I expected. I&#8217;m hoping to do it again tomorrow again.  I did the run as more of an easy jog and ran it in <b>30:15</b>.</p>
<p>After work, M and I had our favorite dinner: our attempt at the Gobbler panini. Tonight was the best yet.  We then hit up the gym where I swam for 1000 yards (I just can&#8217;t stand to do it any longer than that. I have to figure out a way to overcome my swimming boredom. I have a feeling getting better at swimming will help me want to stay in the pool longer). After the swim, I did a full body lifting session. I&#8217;m hoping to amp up the weight lifting, particularly after the triathlons are over.</p>
